“Live Free” and Thrive: New Hampshire Adds Three New Right to Refuse Laws to Four Existing Protections!
Known for its freedom ethic, New Hampshire lives up to its reputation with three new Right to Refuse laws recently enacted. These add to already-existing protections passed during the COVID-19 pandemic. We salute the groups supporting these bills! See them on righttorefuse.org.
Medical Freedom in Immunization
HB220was signed by Governor Sununu 07/23/2021. The Medical Freedom in Immunization law protects folks’ right to bodily integrity and freedom from unwanted immunization. Under it, no person may be compelled by a government entity, including school districts, to get a COVID-19 vaccine in order to secure, receive, or access any public facility, any public benefit, or any public service including. This law does not supersede laws requiring certain vaccines for school admission nor to any state entity run medical facility. Immunization committee is established.
Religious Exemptions, Vaccine Registry, Patient Rights
Next, HB1035 Removes the requirement that a parent’s request for a religious exemption to immunizations required for school attendance be notarized. This bill was signed by Governor Sununu 05/20/2022. HB1488 expands the prohibition against discrimination based on an individual’s election not to participate in the state immunization/vaccination registry to include schools, childcare agencies, and government health agencies. And HB1003 provides that a patient shall not be denied admission, care, or services based solely on the patient’s vaccination status.
No Vaccine Passports
HB1495 was passed on June 24, 2022. It prohibits the state of New Hampshire and its political subdivisions from requiring any business to require vaccination or documentation of vaccination or immunity from customers or employees, except for state agencies certifying a medical facility or provider which is subject to a Medicare or Medicaid vaccination requirement.
Medical Facilities Added to Medical Freedom Bill
HB1604, also signed on June 24, adds state medical facilities to statute protecting medical freedom in vaccination. Requires state hospitals and medical facilities to grant religious and medical exemptions from vaccination requirements, provided that any request for a medical exemption shall include the supporting documentation required by federal regulation. The bill also includes case management agencies in the definition of home health care providers licensed as health facilities.
No Cooperation with Federal Vaccine Mandates
Finally, HB1455 passed on July 1, 2022. It prohibits state enforcement of any federal law, order, or rule that requires an individual, as a condition of employment or any other activity, to provide proof of vaccination against COVID-19 or to submit more than once per month to COVID-19 testing.
Taken together, all of these laws provide a wide spectrum of protection for folks in New Hampshire. This freedom-minded state’s successes should be an inspiration for health freedom activists around the USA!
